(LinkedIn)<\/cite><\/div>\n<p class=\"text_text__nEn66\">The\u00a0<a class=\"link_link__LDfG6\" href=\"https:\/\/www.unilad.com\/health\">health plan<\/a> was in place to ensure that employees were entitled to earn three-quarters of their agreed earnings, which meant that Clifford was earning an annual salary of \u00a354,000 ($70,447) &#8211; despite not working a single day in 15 years.<\/p>\n<p class=\"text_text__nEn66\">It was reported he will continue to earn this amount until he is 65, which will equate to over $1.9 million.<\/p>\n<p class=\"text_text__nEn66\">However, this seemingly wasn\u2019t enough for Clifford, who took IBM to an employment tribunal on the grounds of disability discrimination.<\/p>\n<p class=\"text_text__nEn66\">He was unhappy that his pay had not increased in the last 10 years, and attempted to sue them.<\/p>\n<p class=\"text_text__nEn66\">Clifford said he had been treated &#8216;unfavourably&#8217; as he&#8217;d received no salary increase since 2013, and warned that the &#8216;value of the payments would soon wither&#8217; due to punishingly high levels of inflation.<\/p>\n<p class=\"text_text__nEn66\">He said to The Telegraph in 2023: \u201cThe point of the plan was to give security to employees not able to work &#8211; that was not achieved if payments were forever frozen.\u201d<\/p>\n<p class=\"text_text__nEn66\">However, things didn\u2019t go in Clifford&#8217;s favour after the employment tribunal dismissed his claim.<\/p>\n<div class=\"article-image_articleImage__eyzAn\">\n<div class=\"article-image_imageWrapper__ANtPE\"><img decoding=\"async\" src=\"https:\/\/images.ladbible.com\/resize?type=webp&amp;quality=70&amp;width=3840&amp;fit=contain&amp;gravity=auto&amp;url=https:\/\/images.ladbiblegroup.com\/v3\/assets\/bltcd74acc1d0a99f3a\/bltd74468228df02f99\/653636c3dc13090a0bca2e04\/ibm.jpg\" alt=\"IBM pay Clifford around $70,000 a year. (Nikolas Kokovlis\/NurPhoto via Getty Images)<\/cite><\/div>\n<p class=\"text_text__nEn66\">Clifford was actually told what we are probably all thinking &#8211; that he was getting a &#8216;very substantial benefit&#8217; and receiving &#8216;favourable treatment&#8217;.<\/p>\n<p class=\"text_text__nEn66\">In the case dismissal, Employment Judge Paul Housego said: \u201cActive employees may get pay rises, but inactive employees do not, is a difference, but is not, in my judgement, a detriment caused by something arising from disability.<\/p>\n<p class=\"text_text__nEn66\">\u201cThe claim is that the absence of an increase in salary is disability discrimination because it is less favourable treatment than afforded those not disabled.<\/p>\n<p class=\"text_text__nEn66\">\u201cThis contention is not sustainable because only the disabled can benefit from the plan.
